Observers notice, that it is necessary to recognise the law unconstitutional and to cancel, as, otherwise, the Republic Moldova will not avoid the next lost business in the European court under human rights (ÅÑÏ×). And in end, lowering details, the commission has considered an interdiction of communistic symbolics and introduction of penal sanctions for its use contradicting the European standards, in particular articles 10 «Freedom of expression of opinion» both 11 «the Freedom of assembly and associations» the European convention under human rights (ÅÊÏ×). In the document it is noticed, that from the point of view of the European prospect the sickle and a hammer cannot be considered in Moldova exclusively as symbols of a communistic totalitarian mode. The commission also specifies, that does not see communication between totalitarian communistic ideology existing in the past and symbols of party of communists (ÏÊÐÌ) which uses a sickle and a hammer last 19 years. «The sickle and a hammer have been registered as unique symbols of party of communists on April, 27th, 1994 and since then are used by it on the lawful bases», - it is marked in imprisonment before trail. The commission underlines, that with this symbolics the party participated in six parliamentary, one presidential and five local elections, and now is the largest opposition party presented in legislature which is not going to dethrone a democratic constitutional order violently.
